It was leaked the same way as most of gold builds of popular video games. It can be patched properly (and made equal with retail installations), starting with update 1.0.1.0 (and onward), which replaces all of build 738's unique binaries (and restores the CD check).

Build 738 is a build of Half-Life, compiled on 1st November 1998. It is the same as retail build 742, except for earlier binaries (and minor resource file differences, which have zero effect on overall gameplay), and does not contain a CD check. It was leaked the same way as most of gold builds of popular video games. It can be patched properly (and made equal with retail installations), starting with update 1.0.1.0 (and onward), which replaces all of build 738's unique binaries (and restores the CD check).
