There aren't even any category for nintendo console when searching.

Cease and desist letter doesn't have any legal power though, its more like a warning but without actual court involvement. One can decide to ignore it, but afaik no letters were even sent by them, right?
Of course its..umm the decision in the wake of what was happening outside that matters here, but yea.

No, the reason is that what BA does is illegal, and Nintendo has shown countless times that they are very intent on shutting down every illegal distribution of any of their intellectual property, no matter how old/unremarkable.
It is simply self-defense
