When the battery of my touch is 100% and plugged..i got no problem
But when i unplug the iPod, the battery goes to 98% or 95% ?.?
How can i fix that?
( and no its not because the battery is dying...i have it for only one week...)

I would return it if you bought it new, it could be a defective battery.

Do you think my jailbreak will be the cause?

Jailbreaking won't have anything to do with it.

There is no problem with your battery, it's just that the charge indicator adapts itself to the stress applied to the battery if you start listening to music the battery will go to 100%, if you're playing games it will go to 96% and lower.

But you must have been playing on it before you removed it from the charger.

Not until you start to see any relevant change in the battery lifetime, this may be just a bug from the iOS if you weren't playing.

You should return it if the battery dies out quicker than usual. I mean if it drops to 95% but the battery still lives long like usual, then you no need to return it.

As far as I'm aware this is normal - my 2G has always done it.

I would say to restore it, then if no avail and under warranty, send to Apple Store.

Don't listen to those two, unless you really feel any change in the battery life returning it to apple store is just a waste of time.
