If PSX will soon be abandonware, why NES is not abandonware?

Maybe unless it's unlicensed abandonware, anything licensed by Nintendo the guys there will sue you for just hosting the ROMs.

Nintendo still technically sells NES roms for the DS and Wii products

Yes but IF there not on the virtual console store they dont sell them. Theres around 300 nes games on the store. One i can think that would go as abandonware would be Mario Is Missing.

For the moment there will be no console abandonware on BA. Regardless if it's Playstation, NES, Sega Master System, Atari 2600 or Pong.
